Receivership

Receivership is a legal process whereby an official receiver is appointed to a company by a secured creditor. The process may be commenced if the loan is not paid back as per the terms of the loan agreement. The receiver is bound by legislation, but can sell some or all of the assets, remove directors and employees, and decide what to do with the company and its assets – ensuring that the secured creditors are paid first.
